Please read these Terms and Conditions ("Terms") carefully before booking or using any charter transportation services provided by Gold Coast Tours ("Company," "we," "us," or "our"). By submitting a charter request, signing a contract, or boarding one of our vehicles, you ("Customer") agree to be bound by these Terms.
Gold Coast Tours provides charter bus and motorcoach transportation services within California and surrounding states. All services are subject to vehicle and driver availability, applicable regulations, and the terms of a written or electronic service agreement between the Company and the Customer.
We reserve the right to refuse service to any person or group whose conduct, in our sole judgment, poses a safety risk or is otherwise inappropriate.
A reservation is not confirmed until a signed contract and required deposit have been received by Gold Coast Tours Deposit amounts and due dates will be specified in the service agreement. Failure to pay a deposit by the due date may result in cancellation of the reservation without further notice.
Full payment is due on or before the date specified in the service agreement. Gold Coast Tours accepts payment by check, ACH transfer, or credit card (subject to a processing fee where applicable). Past-due balances may be subject to a late fee of 1.5% per month or the maximum rate permitted by law, whichever is less.
Cancellations must be submitted in writing. The following schedule applies unless otherwise stated in the service agreement:
Gold Coast Tours reserves the right to cancel service due to circumstances beyond our control, including but not limited to mechanical failure, severe weather, driver illness, or road closures. In such cases, we will make reasonable efforts to arrange alternative transportation or provide a full refund.
Changes to trip date, time, itinerary, or passenger count must be requested in writing and are subject to availability and potential price adjustments. Changes made within 48 hours of service may not be accommodated.
All passengers are expected to behave in a safe and respectful manner. The driver has the authority to stop and discharge any passenger whose behavior endangers the safety of others or damages the vehicle. In such cases, no refund will be issued.
Trips designated as SPAB under California law require a SPAB-certified driver and a SPAB-compliant vehicle. Gold Coast Tours will assign appropriately certified personnel and equipment for all trips identified as SPAB at the time of booking. Customers are responsible for accurately identifying trips involving school pupils and school-sponsored activities.
Charter rates are quoted based on estimated trip time. If actual service time exceeds the contracted hours, overtime charges will apply at the hourly rate specified in the service agreement, billed in 30-minute increments. Traffic delays, extended loading times, and itinerary changes by the Customer are common causes of overtime.
The Customer is responsible for the cost of any damage to the vehicle caused by passengers, including but not limited to vandalism, spillage requiring professional cleaning, broken fixtures, or excessive soiling. A cleaning fee of not less than $250 may be charged for vehicles requiring extraordinary cleaning. Gold Coast Tours will provide documentation of damage and associated costs.
Gold Coast Tours is not responsible for personal property left on or in any vehicle. Passengers are encouraged to check for all belongings before departing. Any items found will be held for 30 days and then donated or disposed of if unclaimed. We are not liable for theft, loss, or damage of personal property.
To the fullest extent permitted by law, Gold Coast Tours' liability for any claim arising out of or related to our services shall not exceed the total amount paid by the Customer for the specific trip giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages of any kind.
Gold Coast Tours is not liable for delays or failure to perform services caused by circumstances beyond our reasonable control, including acts of God, traffic conditions, mechanical breakdown of non-Gold Coast Tours vehicles, government actions, or other force majeure events.
Gold Coast Tours maintains commercial motor vehicle liability insurance as required by the California Public Utilities Commission (CPUC) and the Federal Motor Carrier Safety Administration (FMCSA). Certificates of insurance are available upon written request.
Gold Coast Tours operates under the authority of the California Public Utilities Commission (TCP #TCP-1133A) and the Federal Motor Carrier Safety Administration (USDOT #US DOT 230226). All drivers and vehicles meet applicable state and federal safety requirements.
Your personal information is handled in accordance with our Privacy Policy. By providing a phone number to Gold Coast Tours, you consent to receive transactional SMS messages related to your scheduled trip. You may opt out at any time by replying STOP.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Orange County, California, and each party consents to the jurisdiction of such courts.
These Terms, together with any signed service agreement or contract, constitute the entire agreement between Gold Coast Tours and the Customer with respect to the services provided. They supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Gold Coast Tours reserves the right to update these Terms at any time. The most current version will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
